1. Acceptance of Terms

Welcome to Squatty Potty, LLC (“Squatty Potty”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern all access and use of our website located at squatlypotty.us (the “Site”), all purchases of products through the Site, and all accounts created on the Site.

By browsing the Site, creating an account, placing an order, or otherwise interacting with our services, you (“you” or “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as our Privacy Policy, Warranty Policy, and all other legal documents hosted at squatlypotty.us.

If you do not accept these Terms in full, you are prohibited from using the Site, creating an account, or purchasing any products from us. You must be at least eighteen (18) years of age to use this Site; if you are under 18, you may only use the Site with direct supervision and consent of a legal guardian, who accepts full liability for your activity.

We reserve the right to revise, amend, or update these Terms at any time without prior written notice. Changes take effect immediately upon posting to squatlypotty.us. Your continued use of the Site after updates constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms regularly.

2. User Account Responsibilities

To place orders or access certain Site features, you may create a customer account. You warrant that all information you submit during registration (name, shipping address, email, payment details, phone number) is true, accurate, complete, and current. You must update your account information promptly if any details change.

You are solely responsible for safeguarding your account username and password. You may not share, rent, sell, or transfer your account to any third party. You agree to immediately notify support@squattypotty.com of any unauthorized login, password breach, or suspicious account activity. Squatty Potty is not liable for any loss, damage, or charges incurred from unapproved access to your account caused by your failure to secure your login credentials.

We reserve the right to suspend, restrict, or permanently terminate your account without advance notice if we detect fraud, policy violations, abuse of customer support, infringement of intellectual property, or other activity that violates these Terms or applicable U.S. federal/state law.

3. Prohibited Conduct

When using the Site, you may not:

Engage in any illegal, fraudulent, harassing, defamatory, abusive, or threatening behavior;
Use automated scrapers, bots, crawlers, or scripts to copy, extract, or overload the Site without our written permission;
Modify, hack, reverse-engineer, or attempt to exploit vulnerabilities in the Site’s code, servers, or payment systems;
Copy, reproduce, distribute, modify, or commercially use any text, images, videos, trademarks, product designs, or branding from the Site without explicit written licensing from Squatty Potty, LLC;
Register domain names, social media accounts, or paid search advertisements that incorporate our registered trademarks (including Squatty Potty®, Poop Better!®, Unicorn Gold®) without prior written approval;
Submit false order information, engage in serial return abuse, or attempt to manipulate pricing, promotions, or discount codes fraudulently;
Upload or transmit malware, viruses, malicious links, or other harmful code through the Site’s contact forms, review sections, or comment areas.

4. Product Orders, Pricing & Payment

All product prices displayed on the Site are in United States Dollars (USD) and do not include state sales tax, shipping fees, or surcharges for expedited, oversized, or bulk orders. We reserve the right to adjust product pricing, discount rules, and promotion eligibility at any time before your order is fully processed and paid. Once payment is confirmed, the price for your order is locked.

Accepted payment methods include Visa, Mastercard, American Express, Discover, PayPal, and Amazon Pay. When you submit an order, we will place a temporary authorization hold on your payment method for the full order amount. If inventory is unavailable or your order is canceled before shipment, all authorized funds will be released or refunded to your original payment source.

Promotional codes, rebates, and limited-time offers carry explicit eligibility rules, expiration dates, and order minimums. Only one promotional discount may be applied per single order unless explicitly stated otherwise. We void any discount code used in violation of its published terms.

5. Shipping & Delivery

Standard free shipping is offered for eligible U.S. domestic orders meeting our posted order minimum threshold. Additional delivery fees apply to rush shipping, oversized items, international shipments, and large bulk orders, and all shipping charges will be clearly displayed at checkout before you complete payment.

All delivery timelines listed on the Site are non-binding estimates only. Squatty Potty does not guarantee delivery dates and is not liable for delays, lost packages, damaged shipments, or missed deliveries caused by third-party shipping carriers, weather disruptions, supply chain shortages, or force majeure events. Risk of loss for all products transfers to you once the carrier accepts your package for shipment.

Unshipped orders may be canceled by emailing support@squattypotty.com before dispatch. Once an order has shipped, you must follow our official return process to receive a refund.

6. Returns, Refunds & Limited Warranty

6.1 Sixty (60) Day Return Policy

All products purchased directly through squatlypotty.us qualify for a 60-day return window starting on the date your order is delivered to you. To initiate a return, you must email our customer support team to receive a Return Merchandise Authorization (RMA) number; packages returned without a valid RMA will be refused by our warehouse.

Returned merchandise must be sent back in original packaging, in unused, resalable condition with all original accessories included. You bear all shipping costs to return items to our fulfillment center. We reserve the right to deduct fees from your refund for missing parts, damaged packaging, or excessive wear to returned goods. Refunds are processed within fourteen (14) business days after our warehouse receives and inspects your returned product, and funds are credited back to your original payment method. Clearance, final-sale, and customized products are non-refundable and non-exchangeable.

6.2 One-Year Limited Product Warranty

Squatty Potty provides a 1-year limited warranty for manufacturing defects on all brand-new items purchased from our official Site or authorized U.S. retail partners. This warranty covers flaws in materials and original craftsmanship only.

The warranty does NOT cover damage from accidental drops, improper use, unauthorized modification, normal wear and tear, improper cleaning, shipping damage, or misuse of the product outside its intended purpose. Under valid warranty claims, we will repair your product or replace it with an equivalent new or refurbished unit at our sole discretion. Proof of purchase is required for all warranty requests. Products bought from third-party unauthorized sellers are not eligible for our direct manufacturer warranty, and you must pursue warranty support through your original retailer.

7. Intellectual Property Rights

All content hosted on the Site, including written copy, photographs, video footage, graphic designs, logos, product molds, illustrations, and website layout, is protected under United States copyright law. All trademarks, service marks, slogans, and product names displayed on the Site are federally registered trademarks owned exclusively by Squatty Potty, LLC.

You may not copy, print, download, edit, distribute, or monetize any copyrighted or trademarked content from our Site without a signed written licensing agreement from our legal team. Any unauthorized commercial use of our intellectual property constitutes infringement under U.S. law, and we reserve the right to pursue monetary damages, account termination, DMCA takedowns, and formal legal action against infringing parties.

8. Medical Disclaimer

All content on the Site, including product descriptions, blog articles, videos, and educational materials, is provided for general wellness and informational purposes only. Nothing published on the Site constitutes medical advice, diagnosis, treatment guidance, or a substitute for professional healthcare consultation. If you experience persistent digestive, intestinal, or bathroom health concerns, consult a licensed physician or gastroenterologist. Squatty Potty disclaims all liability for personal health outcomes resulting from reliance on content posted to our Site.

9. Limitation of Liability

To the maximum extent permitted by Utah state and U.S. federal law, Squatty Potty, its officers, employees, affiliates, and fulfillment partners shall not be held responsible for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the Site or purchase of our products, including lost business profits, lost revenue, business interruption, or personal injury secondary to product misuse.

Our total aggregate liability for any claim related to your order or Site access is capped at the total dollar amount you paid to us for the relevant order. Certain U.S. states do not allow limitations on incidental or consequential damages, so this liability cap may not fully apply to you if you reside in such jurisdictions.

10. Force Majeure

Squatty Potty shall not be liable for any failure or delay in fulfilling our obligations under these Terms caused by events outside our reasonable control, including natural disasters, labor strikes, supply chain shutdowns, government regulatory restrictions, cyberattacks, server outages, or carrier service disruptions. We will notify you promptly if a force majeure event impacts your order fulfillment, and we may cancel affected orders with a full refund at our option.

11. Governing Law & Dispute Resolution

These Terms, all orders placed through the Site, and all claims or disputes between you and Squatty Potty shall be governed exclusively by the substantive laws of the State of Utah, without regard to Utah conflict-of-law rules. Any legal proceeding related to these Terms must be filed exclusively in the state or federal courts located in Washington County, Utah.

You expressly waive your right to participate in class-action lawsuits or class arbitration against Squatty Potty. All disputes must be resolved through individual binding arbitration in Washington County, Utah, and you waive all rights to jury trial for any claim arising from your use of the Site or product purchases. All arbitration filing fees and administrative costs shall be allocated per the rules of the American Arbitration Association (AAA).

12. Account Termination

You may stop using the Site and discontinue your account access at any time. We retain the unilateral right to suspend access or fully terminate your user account immediately, without refund or further obligation, if we determine you have materially breached any provision within these Terms, including intellectual property infringement, fraudulent ordering, repeated policy violations, or illegal activity linked to your account.

Upon account termination, all licenses and permissions granted to you to use the Site are revoked instantly, and you must cease all access to our platform and delete any proprietary Squatty Potty content in your possession. Sections of these Terms that logically survive account termination (including intellectual property rules, liability limits, governing law, and dispute resolution clauses) remain fully enforceable.

13. Miscellaneous Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, Warranty Policy, and all supplementary legal pages at squatlypotty.us, form the complete binding agreement between you and Squatty Potty regarding Site use and product sales. No verbal statements, informal email communications, or third-party advertisements modify or supersede these written Terms unless executed as a formal signed addendum by our corporate legal department.

13.2 Severability

If any single clause within these Terms is ruled invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall remain in full legal force and effect.

13.3 No Waiver

Failure by Squatty Potty to enforce any violation of these Terms does not waive our right to enforce that same provision against future breaches by you or other users.
